The Financial Services Authority requires that we provide
you with what is known as a Key Facts document also known
as the Initial Disclosure Document (IDD) to tell you
about the services that we offer. It explains the products
that we are able to recommend to you, our status and
our charging methods. Our Terms of Business explains
the different aspects of the way in which we operate
and how this all affects you, the customer. This Terms
of Business document will be effective from the date
of receipt, but it may be amended by us following any
initial interview intended to establish your current
financial situation, objectives and attitude to financial
risk. Any such amendment to the Terms of Business document
will be forwarded to you within 10 working days of the
day that the interview took place. However, irrespective
of any amendments arising from such interviews, we reserve
the right to amend the terms of this document without
your consent, but we will give you at least 10 business
days notice before conducting any relevant business,
unless we consider it unfeasible to do so under the conditions
present at that time.
- Our Status
The Finance Brokerage Limited is authorised and regulated
by the Financial Services Authority(FSA). Our FSA number
is 466102. Our officially recognized business includes
advising on and arranging mortgages and non-investment
insurance contracts. You can check this on the FSA's
Register by visiting the FSA's website: or
by contacting the FSA on 0845 606 1234. During
busy periods and where particular expert advice is needed,
to ensure that your enquiry is dealt with as quickly
and competantly as possible we may pass your enquiry
to another FSA registered mortgage intermediary who will
offer you the same professional competency as we do ,
they may charge a fee. If they do charge a fee this will
be disclosed to you on their first point of contact ,
they will contact you directly and deal with your enquiry.
- Are we covered by the Financial Services Compensation
Scheme (FSCS)?
Yes we are covered by the FSCS. You may be entitled to
compensation from the scheme if we cannot meet our obligations.
This depends on the type of the business and the conditions
of the claim made.
Investment: most types of investment businesses are covered
for the first 100% of the first £30,000 and 90% of
the next £20,000 so the maximum compensation that
one can get is limited to £48,000.
Insurance: insurance for advising and arranging is covered
for 100% of the first £2,000 and 90% of the remainder
of the claim, without any upper limit attached.
Mortgages: mortgage advising and arranging is covered for
100% of the first £30,000 and 90% of the next £20,000
so the maximum compensation is £48,000.

- Records
We will, if requisite by you or your agents, supply copies
of contract notes and copies of entries in books, records
and computerised record relating to you. We undertake
to maintain such records for a period of at least six
years from the date of each and every transaction for
you.
- Personal Interests
We undertake not to carry out business for you which we
or one of our customers or any director/partner/employee
has a known concern if we become aware that these concerns
conflict with yours, unless that the concern is at first
disclosed in writing and your consent obtained.
- Instructions
Normally, we ask customers to offer instructions in writing
by completing the relevant application form and signing
the appropriate declaration. Where you have a right to
cancel your purchase, the product providers will give
you notice of this in writing. Our authority is to act
on your behalf in agreement with these Terms of Business
can be terminated at any time by either side in writing,
without prior notice and without penalties. This will
be effective from the date that the notification is received.
However, transactions already initiated remain outstanding,
the notification will only be effected once these have
been completed.
- Ownership
As an agent, we never own the products you buy or carry
out though us. Purchases will therefore be registered
in the name(s) of the client(s) and we will forward to
you, all these documents showing tenure of your purchases,
as soon as it is practicable after we receive them. In
some cases, product provider will send the documentation
directly to you.
- Review
Our services are in particular geared to providing a telephone, internet or postal
based service. For mortgage and non-investment insurance contracts, we may
make a diary note upon completion of your transaction to re-contact you at
a future date. The purpose of this would be for us to carry out a follow up
review, as it may not be in your interests to remain with the initial product
suggested. In addition, from time to time we may become aware of opportunities
to make you aware of additional products and services. Where this occurs we
may contact you, unless you expressly request otherwise. In addition, should
you have any needs in the future regarding any of the services we offer, then
we would always be happy to hear from you. During busy periods and where particular
expert advice is needed, and to ensure that your enquiry is dealt with as quickly
and competently as possible, we may pass your enquiry to other FSA registered
mortgage intermediaries, they will l contact you directly and deal with your
enquiry. Our service is free to you but to operate this service we receive
fees from the lenders or brokers we refer you to . some of these brokers may
charge a fee , but if they do they will tell you up front.
- Data Protection
Information provided by you may be held, processed, disclosed
and used by us, our professional advisers and any associated
companies servicing our relationship with you. We hold
the personal information provided by you securely and
in confidence in our computerised and manual records.
By submitting your personal information to us you agree
that: information we hold about you can be held on computer
and/or paper files; any information which you give us
may be disclosed to selected third parties and group
companies for the purpose of obtaining a service , marketing
and of administration. Please note that we will not arrange
to involve a third party, unless the security and discretion
of your personal information is assured. We and any group
companies, or selected third parties to whom we have
passed your information may use the information to contact
you by post, fax, e-mail or telephone to bring to your
attention additional products or services, which may
be of interest to you. However, if you would prefer to
be excluded from these services, please write to us at

- Client Money
WE DO NOT HANDLE CUSTOMERS' MONEY.
- Safeguards
For your protection, we are licensed by the Office of Fair
Trading under the Consumer Credit Act, registered under
the Data Protection Act, and authorised and regulated
by the Financial Services Authority. The Consumer Credit
Act 1974 will only apply to non-regulated mortgages.
If the mortgage we arrange for you is a regulated mortgage
contract, our advice to you, the information we disclose
and any mortgage offer you receive is subject to FSA
regulation and you will have the full protection of the
Financial Services and Markets Act 2000 in our dealings
with you. Please be aware that most business mortgages,
buy-to-let mortgages, loans for timeshare purposes and
non-regulated investment accounts (i.e. deposit, or current
accounts) do not fall under the Financial Services Authority's
umbrella of protection.
- Call recording
Telephone calls to The Finanace Brokerage Limited may be
recorded and used for training, or regulatory purposes.
- Fees
The Finance Brokerage Limited does not charge a fee for
mortgage, or protection advice, but you should be aware
of the likelihood that other taxes or costs relating
to the services that we provide for you may exist even
though they are not paid through us, or obligatory by
us. Third parties we refer your enquiry to have a discretion
to charge a fee , however they will inform you on the
first point of contact , if they will charge a fee.
- Law
English law will be the basis of this contract and the
language which this contract will be interpreted, and
in which all communications will be conducted, will be
English. The Contracts (Rights of Third Parties) Act
1999 shall not apply to this Terms of Business.
